New HIV case causes LA porn industry shutdown

LOS ANGELES (AP) — An adult film performer has tested positive for HIV, causing porn producers to shut down shoots in Southern California as the diagnosis is confirmed through re-testing, according to an industry group.

Free Speech Coalition executive director Diane Duke told The Los Angeles Times (http://lat.ms/mX0vin) on Monday that her group became aware of the HIV case Saturday.

A series of tests were being conducted on the performer to confirm the case before anyone the performer might have spread the illness to will be notified to get tested, Duke told The Associated Press.

She didn't know how long that would take.

Duke declined to release the performer's name, age or gender, citing the person's federal right to medical privacy. She also declined to say how her group learned of the case.

The case was found in an out-of-state clinic that doesn't report to California health officials, said Duke.

If the initial case is confirmed, the group will ask two generations of the person's sexual partners to get tested, meaning those who had sex with the performer and the sexual partners of those who had sex with the performer.

The voluntary industry shutdown affects porn producers in the San Fernando Valley, the heart of the multi-billion dollar American porn industry, and includes Hustler and Evil Angel's productions.

The porn industry was shut down similarly in late 2010, after porn actor Derrick Burts was diagnosed HIV positive.

Burts has since gone on to advocate for the mandatory use of condoms in porn with the AIDS Healthcare Foundation.

The health advocacy group and state workplace safety officials say state law mandates porn performers to use condoms to protect themselves under the same set of rules that require nurses to wear gloves in hospitals when dealing with bodily fluids.

Cal/OSHA is working to clarify the regulation to make it more specific to porn.

Earlier this month, the health advocacy group announced that it will gather 41,138 petition signatures to get the issue of condoms in porn on the June 2012 ballot.

The ballot measure would ask Los Angeles residents whether porn producers must require performers to use condoms on shoots as a condition of getting a filming permit.

"The question remains how many performers must become infected with HIV and other serous STDs before the industry will clean up its act and government will do the right thing?" said Michael Weinstein, president of AIDS Healthcare Foundation.

The group has unsuccessfully pushed California and Los Angeles County officials to tighten enforcement of condom use on porn sets through legislative attempts, lawsuits and regulatory complaints.

One 12-ounce can of Coke is 155 calories, so if your child has two a day, that adds up to almost a quarter of his or her recommended daily calorie intake. Snapple and fruit juices may be natural, but they often contain even more calories than soda. Serve them only water, skim milk, unsweetened teas, and sparkling waters with fruit slices.

Snacking Instead of Meals: Many parents complain that when it's dinnertime, their child says he or she is full and only eats a bit of what is hopefully one of the day's most nutritious meals. Oftentimes, the real culprit is that the child is filled with empty calories and carbs from snacking throughout the day. Snacking can be encouraged between meals, especially for active kids, but should be limited to foods packed with fiber and complex carbs, such as an apple, carrots with hummus, or a handful of nuts. Also, the rule of the house should be no snacks two hours before dinner.

Being the Decision Maker: When you don't include your child in on the decision of what to have for lunch or dinner, some children, especially toddlers and teenagers, might turn it into a power play and refuse to eat. Genetic cancer test often urged for wrong women



In a survey of nearly 1,900 U.S. physicians, they found about 30 percent said they'd refer women at average risk of the disease, although several guidelines discourage that.
By contrast, as many as 60 percent said they wouldn't refer a woman at high risk, which guidelines do encourage.
"Physicians aren't doing as good a job as we should at identifying people who should and should not be referred for counseling or testing," said Dr. Michael LeFevre of the U.S. Preventive Services Task Force (USPSTF), who was not involved in the new survey.
Ovarian cancer isn't very common -- it strikes just one in 71 women, many of them elderly, whereas one in eight women get breast cancer.
But because there aren't any good screening tests for ovarian cancer, it's usually not discovered until it's too late.
However, a small percentage of women carry mutations in the BRCA 1 and 2 genes, which make them very likely to develop both breast and ovarian cancer.
Last month, a federal appeals court upheld patents for those two genes by Salt Lake City-based Myriad Genetics.
The company charges $3,340 to test BRCA 1 and 2 for cancer-causing mutations, but told Reuters Health that patients usually end up paying only $100 out-of-pocket.
Still, with just one in 300 or fewer women carrying the mutations, testing those at average risk would put needless strain on the health care system, said Dr. Jacqueline Miller, who worked on the new survey.
"You would be over-testing a lot of women, spending a lot of resources and a lot of money," Miller, of the Centers for Disease Control and Prevention in Atlanta, told Reuters Health.
And it's possible there would be a few false alarms, too, exposing women to unnecessary treatment and other harms, she added.
"For a lot of women, just going through the test creates a lot of anxiety," Miller explained.
The survey, published in the journal Cancer, is based on three fictional patient cases -- one at average risk, one at medium risk and one at high risk.
The USPSTF, a federally supported expert panel, advises against routine counseling and testing for women who don't have suspicious cases of cancer in their family, such as two close relatives with breast cancer, one of whom got it before 50.
"High risk is a little bit complicated," acknowledged LeFevre.
"Physicians can't be expected to carry all of these nuances around in their brain, but I think they should know what the triggers are."
Indeed, the survey suggests doctors who were better at assessing risk were more likely to follow the guidelines.
Yet even when they correctly put a woman in the average risk category, 22 percent of doctors still referred her for counseling or testing.
For those women at high risk, getting genetic counseling and possibly testing may help them decide how they want to deal with that risk.
For instance, 57 percent of women with BRCA 1 mutations get breast cancer by age 70, and 40 percent get ovarian cancer.
Choosing to have the breasts and ovaries removed, or taking certain medications, will cut that risk, said Miller.
"Part of the counseling has to be: here are the options," she explained.
To Miller, the most important lesson from the new finding is to make sure that women at high risk are identified so they can get the right counseling.
But she added that women should never agree to get tested without knowing the reasons.
"You should have that conversation with your provider: why do you feel I'm at high risk?" Miller said.
"If a physician tells you should get genetic counseling, you should understand why."
